RESRC STUDIOS TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the RESRC Studios website, booking services, studio space, equipment, classes, workshops, and other services offered by RESRC Studios (“RESRC,” “we,” “us,” or “our”).

By accessing our website, submitting a reservation, purchasing a service, or using the studio, you agree to these Terms and the RESRC Studios Rental

Agreement & Booking Policies presented during checkout.

1. About RESRC Studios

RESRC Studios operates a creative rental studio located in Anaheim, California. The studio may be used for approved photography, video production, content creation, classes, workshops, events, and related creative activities.

Unless specifically stated otherwise, a standard studio rental includes access to both the Main Studio and Daylight Room during the reserved time.

2. Eligibility and Authority

You must be at least 18 years old to make a booking.

When booking for a company, production, organization, client, or other person, you represent that you have authority to accept these Terms on their behalf.

The person who makes the booking is the “Renter” and is responsible for:

All guests, crew members, clients, models, vendors, and attendees

Compliance with these Terms and the Booking Policies

All charges, damages, missing items, and violations connected with the booking

Obtaining any necessary permissions, releases, licenses, permits, and insurance

3. Website Use

You may use our website only for lawful purposes.

You may not:

Attempt to interfere with or damage the website

Access restricted systems or information without authorization

Submit false, fraudulent, or misleading information

Use automated systems to scrape, copy, or overload the website

Impersonate another person or misrepresent your authority

Use the website in violation of applicable law

We may restrict or terminate website access when we reasonably believe these Terms have been violated.

4. Bookings

A reservation is not confirmed until payment has been successfully processed and RESRC has issued a booking confirmation.

You are responsible for reviewing your booking confirmation and immediately notifying us of any errors involving:

Date

Start or end time

Selected services

Equipment or add-ons

Contact information

Number or type of attendees

Intended use of the studio

Bookings may not be transferred, resold, or assigned without prior written approval from RESRC.

We may request additional information or approval for larger productions, classes, events, special effects, animals, unusual equipment, or activities that could affect the studio, neighboring businesses, building, or other renters.

5. Payment and Additional Charges

Payment is due at the time of booking unless RESRC agrees otherwise in writing.

Prices, taxes, deposits, add-ons, and other charges will be shown during checkout or included in a written quote.

The Renter agrees to pay any additional amounts resulting from the booking, including approved or documented charges for:

Overtime

Additional equipment or services

Damaged or missing property

Unauthorized paper backdrop use or cutting

Excessive cleaning or failure to reset the studio

Repairs required because of the Renter or their guests

Unauthorized use of the space

Returned payments or payment disputes

Other charges permitted under the Booking Policies

Where authorized during checkout, RESRC may charge the payment method on file. Otherwise, RESRC may send an invoice, which must be paid by the stated due date.

6. Reservation Time

The reserved time includes all:

Arrival and load-in

Setup

Photography or filming

Wardrobe and makeup

Breaks

Cleanup and studio reset

Breakdown and load-out

Renters may not enter before their scheduled start time unless RESRC has provided approval.

The studio must be completely vacated by the scheduled end time. Extra time is not guaranteed and is subject to availability and approval.

Approved or unauthorized overtime may be charged at the applicable overtime rate.

Late arrival does not extend the reservation.

7. Cancellation and Rescheduling

Cancellations, credits, and rescheduling are governed by the Booking Policies presented during checkout and in effect when the reservation is made.

Unless RESRC agrees otherwise in writing:

A booking may only be rescheduled once

Same-day reschedule requests must be made before the scheduled start time

A same-day rescheduled booking must be used within 7 days

Other approved reschedules or booking credits must be used within 30 days

No-shows do not qualify for a refund, credit, or reschedule

Late arrivals and early departures do not qualify for refunds, credits, additional time, or rescheduling

A failure to use an approved credit within the applicable period will cause the credit to expire.

8. Changes or Cancellations by RESRC

RESRC may change, suspend, or cancel a booking when reasonably necessary because of:

Unsafe conditions

Building or equipment problems

Power, water, internet, or utility outages

Government orders

Emergencies

Severe weather

Circumstances outside our reasonable control

Misrepresentation or violation of these Terms

When RESRC cannot reasonably provide the reserved space for reasons not caused by the Renter, the Renter may choose between:

Rescheduling the affected booking

Receiving a booking credit

Receiving a refund of the amount paid for the affected service

RESRC is not responsible for the Renter’s separate production expenses, including talent, crew, travel, rentals, vendors, lost revenue, or client commitments.

9. Renter and Guest Responsibility

The Renter is responsible for the behavior and safety of everyone connected with the booking.

The Renter must:

Maintain reasonable supervision over guests and crew

Follow instructions provided by RESRC

Keep exits, walkways, doors, and safety equipment accessible

Use equipment only for its intended purpose

Promptly report damage, hazards, accidents, or equipment problems

Ensure minors are continuously supervised by a responsible adult

Prevent unauthorized persons from entering the studio

Avoid disturbing neighboring businesses or other building occupants

Follow all posted building, parking, fire, and safety rules

RESRC may stop an activity or end a booking when it reasonably believes the activity is unsafe, unlawful, disruptive, damaging, or materially different from the approved booking purpose.

A booking ended because of a violation does not qualify for a refund or credit.

10. Studio Rules and Prohibited Activities

The studio may only be used for the activity disclosed during booking.

The following are prohibited unless RESRC provides prior written approval:

Smoking or vaping

Illegal drugs

Open flames

Pyrotechnics

Firearms or other weapons

Smoke, fog, or haze machines

Confetti, glitter, sand, powders, feathers, or similar materials

Paint, body paint, oils, fake blood, liquids, or messy food effects

Animals

Large or unusually heavy equipment

Attaching items to walls, ceilings, doors, windows, or floors

Drilling, painting, construction, or permanent alterations

Activities creating excessive sound, vibration, odor, heat, or electrical demand

Activities that may damage or stain the studio

Unlawful, dangerous, or sexually exploitative activity

Nudity and sexually explicit activity are not permitted in the Daylight Room or in any area visible from the street, building common areas, or neighboring properties.

The maximum studio occupancy is 50 people, or any lower limit stated for a particular booking or activity.

11. Equipment, Furniture, and Props

Included equipment and amenities are limited to those listed in the booking description or written confirmation.

Equipment, furniture, and props must:

Remain inside the studio unless otherwise approved

Be used safely and for their intended purpose

Be returned to their designated location

Be left in substantially the same condition in which they were provided

The Renter must inspect equipment before use and immediately report anything that appears damaged, unsafe, or nonfunctional.

The Renter may not repair, disassemble, modify, tape, paint, or alter RESRC property without approval.

RESRC may make reasonable equipment substitutions when necessary. Specialized equipment should be confirmed before the booking when it is essential to the production.

12. Paper Backdrops

Standard mounted paper backdrop colors included with the booking may be used under the current Booking Policies.

Color Paper Backdrops and other specialty paper options may require an additional fee.

Paper may not be:

Cut without permission

Removed from its mounting system

Painted, permanently altered, or intentionally damaged

Used for liquids, food effects, oils, paint, or other messy materials without approval

Normal use is expected. Excessive, unauthorized, or avoidable damage may result in an additional charge.

13. Cleaning and Studio Reset

The studio must be returned to its baseline condition before the reservation ends.

The Renter must:

Remove personal property and production materials

Place trash in the appropriate receptacles

Clean spills immediately

Return furniture, props, and equipment to their designated locations

Remove tape, decorations, and temporary installations

Leave floors, surfaces, kitchenette, makeup areas, and common spaces reasonably clean

Close and secure doors as instructed

Normal cleaning between bookings is included. Additional fees may apply when excessive cleaning, repairs, trash removal, or staff time is required because the studio was not properly reset.

14. Damage and Missing Property

The Renter is responsible for damage, loss, theft, or excessive wear caused by the Renter or anyone connected with the booking.

The Renter must notify RESRC immediately when damage or loss occurs. Reporting an issue does not automatically create a charge, but failing to report it may be considered when determining responsibility.

Charges may include the reasonable cost of:

Repair

Replacement

Cleaning

Disposal

Installation

Shipping

Vendor or technician labor

Lost use of the affected space or equipment

RESRC will provide reasonable documentation for material damage charges.

15. Personal Property

The Renter is responsible for all personal property brought into the studio.

RESRC is not responsible for theft, loss, or damage to cameras, computers, production equipment, vehicles, wardrobe, props, personal belongings, or other property except to the extent caused by RESRC’s legally actionable conduct.

Items left behind may be moved, stored, discarded, or donated. Storage is not guaranteed, and RESRC may charge reasonable shipping, handling, or storage costs.

16. Parking, Access, and Security

Renters and guests must follow all provided parking, access, lockbox, alarm, and building instructions.

Access codes and entry instructions may only be shared with authorized members of the booking.

Renters may not:

Block fire lanes, driveways, neighboring businesses, or building entrances

Leave exterior doors or the roll-up door unsecured

Permit unrelated individuals to enter the building

Duplicate, publish, or retain access information after the booking

The Renter is responsible for parking citations, towing, vehicle damage, and other parking-related issues involving the Renter or their guests.

17. Content, Releases, and Intellectual Property

The Renter is solely responsible for content created or displayed during the booking.

The Renter must obtain all necessary:

Model and appearance releases

Location or property releases

Music and media licenses

Brand and trademark permissions

Client approvals

Permits

Parent or guardian consent for minors

The Renter retains ownership of content created during the booking.

RESRC does not obtain the right to publish or use the Renter’s content merely because it was created at the studio. RESRC may only use renter-created content with permission or as otherwise permitted by law.

All RESRC website content, branding, photographs, graphics, layouts, and written materials are owned by or licensed to RESRC and may not be copied or commercially used without permission.

18. Assumption of Risk

Creative production environments may involve cords, light stands, electrical equipment, elevated equipment, heavy furniture, paper rolls, ladders, trip hazards, moving equipment, doors, loading activities, and other production-related risks.

The Renter voluntarily assumes the ordinary and reasonably foreseeable risks associated with:

Entering and using the studio

Operating production equipment

Moving furniture or props

Participating in the Renter’s planned activities

The conduct of the Renter’s guests, crew, vendors, and participants

The Renter is responsible for operating their production in a safe and professional manner.

Nothing in these Terms is intended to waive liability that cannot legally be waived.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the website, studio, equipment, amenities, and services are provided on an “as available” basis.

RESRC does not guarantee:

That the website or third-party booking platform will always be uninterrupted

That every item of equipment will be available unless specifically confirmed

That the studio will be suitable for every production purpose

Particular lighting, sound, internet, temperature, or ambient conditions

Any specific creative, commercial, or production result

These disclaimers do not limit any warranty or legal right that cannot be excluded under applicable law.

20. Limitation of Liability

To the fullest extent permitted by law, RESRC will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the website, booking, studio, equipment, or services.

Except for liability that cannot legally be limited, RESRC’s total liability arising from a specific booking will not exceed the amount paid to RESRC for that booking.

These limitations do not apply to fraud, willful misconduct, gross negligence, violations of law, or other liability that may not legally be excluded or limited.

21. Indemnification

The Renter agrees to defend, indemnify, and hold harmless RESRC and its owners, employees, assistants, contractors, landlord, and representatives from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from:

The Renter’s use of the studio

The actions of the Renter’s guests or crew

Violation of these Terms or the Booking Policies

Injury or property damage caused by the Renter or their guests

The Renter’s content or production

Failure to obtain necessary permissions, releases, licenses, insurance, or permits

This obligation does not apply to the extent a claim was caused by RESRC’s own legally actionable conduct.

22. Third-Party Services

The website and booking process may use third-party services for scheduling, payments, email, text messages, embedded content, maps, or other functionality.

Those services may be governed by their own terms and privacy policies. RESRC is not responsible for a third-party provider’s independent systems, policies, outages, or conduct.

23. Privacy and Communications

Our collection and use of personal information are governed by the RESRC Studios Privacy Policy.

By making a booking, you consent to receive communications reasonably necessary to manage the transaction, including:

Booking confirmations

Access instructions

Reminders

Schedule changes

Payment notices

Safety or operational updates

Post-booking follow-up

Marketing messages will be sent only where permitted by law and may be opted out of using the method provided in the message.

24. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

Before filing a lawsuit, the parties agree to make a reasonable good-faith effort to resolve the dispute directly.

Unless applicable law requires otherwise, legal proceedings arising from these Terms or a booking must be brought in a state or federal court located in Orange County, California.

Either party may bring an eligible claim in small claims court.

25. Changes to These Terms

RESRC may update these Terms periodically.

Material changes will apply prospectively. The Terms in effect when a booking is made will generally govern that booking unless:

The parties agree otherwise

A change is required by law

The change concerns safety or conduct and must be applied immediately

The effective date at the top of the document identifies the current version.

26. Entire Agreement

These Terms, together with the following, form the agreement between RESRC and the Renter:

Booking confirmation

Rental Agreement & Booking Policies

Add-on descriptions

Written quotes or approvals

Any separately signed agreement

Booking-specific written terms control if they directly conflict with these general Terms.

The Privacy Policy describes information practices but does not reduce the Renter’s obligations under these Terms.

27. Severability and Waiver

If a provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary. The remaining provisions will remain effective.

A failure by RESRC to enforce a provision on one occasion does not waive the right to enforce it later.
